The Nevada Legislative Session produced several bills that will protect seniors from fraud and deceptions, provide a fund to compensate victims of securities fraud, and to further protect people appointed a guardian. The Senior Coalition of Washoe County supported the bills below that were signed into law.
SB60 increases the penalty for various frauds and deceptions on people age 60 and older or people who are vulnerable. SB60 expands the types of crimes that require the imposition of an additional criminal penalty or certain crimes committed intentionally or knowingly against an older or a vulnerable person; providing that persons convicted of these types of crimes may be liable for civil penalties to be recovered by the Nevada Attorney General.
SB76 will go a long way to help victims defrauded of money. It will create a state restitution fund to compensate victims of securities fraud. SB76 also provides the Fund for the Compensation of Victims of Securities Fraud and prescribes the use of money in the Fund; authorizing persons to whom a court orders restitution to apply for compensation from the Fund; and requiring the Administrator of the Securities Division of the Office of the Secretary of State to review applications for and award compensation from the Fund.
AB 65 revises provisions relating to certain investigative services provided during a guardianship proceeding; prohibiting a governmental entity from charging a fee for providing a copy of certain documents relating to a guardianship proceeding; revising provisions relating to service of process of a citation and petition in a guardianship proceeding; changing the name of the State Guardianship Compliance Office to the State Guardianship Office.
AB361 Enables Washoe and Clark counties to add more protection for transit operators. AB361 allows certain counties to take certain actions to mitigate safety risks to transit operators; and providing other matters properly relating to
actions to mitigate safety risks to transit operators, including, without limitation, installing and maintaining appropriate infrastructure and technology designed to mitigate safety risks to transit operators such as the use of barriers, panic buttons and other technology; and to install and maintain appropriate signage informing the public about the criminal penalties for certain crimes committed against transit operators or the public.
And finally, AB514 adds Medicaid coverage for rehabilitative mental health care in licensed residential care facilities. AB514 creates a waiver to allow coverage of such services.
